Patricia Santangelo Requests Trial vs. RIAA

Days after losing a motion to have her case dismissed, RIAA victim Patricia Santangelo has requested a trial. This woman seems determined to have her day, regardless of the expense and headache that entails. The refusal to dismiss was a blow to hopes that defendents in these cases would be motivated to stand up to the RIAA when they believe themselves innocent of file-sharing charges. There was a good chance Santangelo would settle with the RIAA after all, rather than take on the expense of further defense. At least one case needs to go to trial (of the roughly 14,000 bullying suits brought by the RIAA to individuals, not a single one has been tried) to begin testing the RIAA's presumptions. Is identifying an IP address sufficient to identify a person? If files were shared by individuals other than the IP-address owner, is the IP owner liable? Does a file necessarily contain music if it has a musical filename? The hope rises again that Santangelo will be the one courageous enough to stand up to the end.
